Commonwealth v. Allen Jerome Smith, Jr.; Convicted Felon Sentenced to 13 Years for Sexual Assault, Burglary

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Allen Jerome Smith Jr., 28 years old, previously residing in the 1300 block of Maltby Street in Norfolk, Virginia, pled guilty before Circuit Court Judge Edward W. Hanson to charges of Aggravated Sexual Battery, Armed Burglary, and Use of a Firearm. Judge Hanson followed the terms of a plea agreement which Smith entered with the Commonwealth and sentenced Smith to a total of 43 years in the Department of Corrections with 30 years suspended, leaving 13 years to serve.  Smith must register as a sex offender for life, as well as remain on 30 years good behavior and indefinite supervised probation upon his release.


Had this matter gone to trial, the Commonwealth’s evidence would have proven that on October 9, 2007 at approximately 5:55 a.m., the victim was home alone asleep in her apartment on Woolard Crescent in the City of Virginia Beach when she was awakened by her blanket being pulled from her body by a stranger. As she awoke, she saw Allen Jerome Smith Jr. dressed entirely in black on the floor near her bed. Smith displayed a firearm and sexually assaulted the victim as he rested his face against her t-shirt on her shoulder. Smith then fled the apartment and the police were called to the scene.  DNA evidence linking Smith to these offenses was recovered from the victim’s t-shirt where Smith had rested his face during the assault.


Smith was previously convicted in Virginia Beach Circuit Court for Burglary (7 counts), Attempted Burglary (2 counts), Grand Larceny (2 counts) and Petit Larceny (4 counts), for which he is currently serving ten (10) years in the penitentiary.  He also has a conviction for sexual assault in 2004.
