Commonwealth v. Marvin L. Rash; Attack Leaves Good Samaritan in Continuing Coma, Defendant to Serve 10 Years

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Marvin L. Rash, 26 years old, who previously resided in the 1100 block of Wooden Shoe Court in Virginia Beach, Virginia, was sentenced today by Circuit Court Judge A. Bonwill Shockley on charges of Malicious Wounding and Assault and Battery of a Family Member.  Judge Shockley sentenced Rash to a total of 20 years in the Department of Corrections with ten (10) years suspended, leaving him ten (10) years to serve. Judge Shockley sentenced Rash above the Virginia State Sentencing Guidelines, which recommended a term of incarceration of no more than five (5) years and 11 months.  Rash pled guilty on April 20, 2010.

Had this matter gone to trial, the Commonwealth’s evidence would have proved that on August 9, 2009, Marvin Rash and his girlfriend joined two friends for a night out.  All four were friendly as they drank at a couple of bars then went to a residence in Virginia Beach.  Rash and the victim, Dennis Jackson, waited outside while the women went into the residence. Eventually, Rash became angry and started pounding on the front door of the home.  When Rash’s girlfriend came outside, she and Rash got into an argument.  When Dennis Jackson noticed Rash punching his girlfriend in the face, he got out of the car. 

Rash turned on Jackson, threw him to the asphalt, and repeatedly kicked him until he was unconscious. Jackson’s friend observed the attack, and Rash took her cell phone when she attempted to call 911.  They put Jackson in the backseat of the car. Rash’s girlfriend drove them home, where Jackson was placed on the pavement.  Rash and his girlfriend then drove off.  Police and rescue units responded and found Jackson unconscious, with blood and vomit in his mouth and a wound to the back of his head.  Today Jackson remains in a vegetative state in a long-term care facility.  He cannot walk, talk, or respond to commands as a result of the attack.  Rash’s girlfriend suffered two swollen black eyes and a cut to her lip; however, she did not cooperate with the investigation and prosecution. 

 

At the time of the assault, Rash was 23 years old, over six (6) feet tall, and weighed about 240 pounds.  Dennis Jackson was 53 years old, five (5) feet six (6) inches tall, and weighed about 175 pounds.
