Commonwealth v. Deandre Jaquan Gordon; Deadly Home Invasion Draws 16 Year Sentence

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Deandre Jaquan Gordon, 21 years old, previously residing in the 5500 block of Aurora Drive in Virginia Beach, Virginia was sentenced by Circuit Court Judge William R. O’Brien on charges of Second Degree Murder, Armed Burglary, and Conspiracy.   Judge O’Brien sentenced Gordon to 34 years in the Department of Corrections, then suspended 18 years, leaving Gordon 16 years to serve.  Gordon pled guilty on January 25, 2011. 


Had this matter gone to trial, the Commonwealth’s evidence would have proved that on December 15, 2008, Deandre Gordon, Edward Aaron Powell, and a third co-conspirator planned to break into the residence of the victim, Nathan Lynch, located in the Plaza Apartment Townhomes in the City of Virginia Beach.  Just after midnight, they kicked in the back door and rushed in.  Unbeknownst to them, Lynch’s mother was in the home recovering from a hospital stay.  Gordon and his co-conspirators put a gun to Ms. Lynch’s head and demanded money, ultimately forcing her from room to room in search of money or drugs.  


During this time, Nathan Lynch returned to the house and was met at the back door by Gordon.  Gordon and Lynch struggled until Powell ran downstairs and shot Lynch once in the chest, killing him.  DNA was recovered from a black knit cap found near Lynch’s foot which was analyzed and found to match Gordon’s DNA.  When interviewed by detectives with the Virginia Beach Police Department, Gordon confessed to his involvement in the burglary and stated that he did not expect anyone to be in the home.


Gordon, who cooperated with the Commonwealth, had prior criminal adjudications as a juvenile for Robbery (Attempt), Assault and Battery, and Destruction of Property, as well as a conviction for Receiving Stolen Property as an adult.  He was also convicted of Armed Robbery, Burglary, Conspiracy, and Use of a Firearm in Virginia Beach Circuit Court, for which he is serving a ten (10) year and 24 month sentence.


Edward Aaron Powell, 20 years old, previously residing in the 5900 block of Margate Avenue in Virginia Beach, Virginia, was sentenced on charges of First Degree Murder, Armed Robbery, Armed Burglary, Conspiracy to Commit a Felony, and three (3) counts of Use of a Firearm.  Circuit Court Judge Les L. Lilley sentenced Powell to 198 years imprisonment with all but 75 years and 8 months suspended.


A third participant is awaiting sentencing on December 14, 2011.
