Commonwealth v. Justin John Geist; Man Sentenced to 12 Years for Sexual Abuse of Minor

Wednesday, June 28, 2017

Colin D. Stolle, Commonwealth's Attorney for the city of Virginia Beach, announced that Justin John Geist, 35 years old, formerly of the 200 block of Palace Green Boulevard in Virginia Beach, Virginia, was sentenced today by Circuit Court Judge James C. Lewis for Object Sexual Penetration of a Victim under the age of 13. Judge Lewis sentenced Geist to 50 years with 38 years suspended leaving 12 years of active time to serve.  The parties had previously agreed the period of active incarceration would not exceed 12 years.  This sentence exceeded the high-end of the Virginia State Sentencing Guidelines.

Geist pled guilty on February 8, 2017.  Had this matter gone to trial, the Commonwealth's evidence would have proven that at some point between March 22nd, 2013 and July 31, 2013, Justin John Geist sexually assaulted the victim.   The victim, who was 10 years old at the time of the incident, was at home in the living room on the couch.  The touching stopped on this particular incident when the victim kicked Geist.   Geist then left the victim alone.  The victim disclosed to two friends about the defendant's inappropriately touching at the time of the incident but made them swear not to tell.

Geist has a prior DUI conviction.

Assistant Commonwealth's Attorney C. Andrew Rice prosecuted this case. Please contact Macie Allen if additional information is desired.
