Commonwealth’s Attorney to Formulate Specialized DUI Prosecution Team

Colin D. Stolle, Commonwealth's Attorney for the city of Virginia Beach, announces the formation of a specialized DUI Prosecution Team at the Virginia Beach Commonwealth's Attorney's Office.  The team, which will consist of five (5) prosecutors and three (3) paralegals, will focus primarily on the prosecution of DUI offenses, allowing them to develop expert knowledge of the intricacies of DUI laws.  Effective January 3, 2017, all DUI cases and traffic felonies will be prosecuted by this specialized team. This will include all cases in which a serious injury or death occurs at the hands of a drunk driver. 

A "driving under the influence" (DUI) charge can result from drinking alcohol as well as taking illegal drugs, designer drugs, or prescription drugs. DUI laws are extremely complex, making prosecution challenging.  In addition, the eventual implementation of body cameras by the police department will create a great deal of video evidence for prosecutors to review.  This specialized team will educate themselves on changes in DUI law, combat novel defenses to these crimes, and ensure that these offenders are brought to justice. 

Although the total number of DUI arrests has decreased slightly in recent years, the Virginia Beach Police Department made over 2,100 DUI arrests in 2016.  Stolle hopes the number of DUIs that occur in the city will continue to decrease. "DUI is a crime that continues to threaten the safety of the Virginia Beach community, and I remain dedicated to devoting resources to combat this problem," Stolle said.  "There are experts in the field of DUI defense, and it's important that expert prosecutors are prepared to challenge these defenses in court."​
