Commonwealth v. Marcus Anthony Upchurch; Man Sentenced to 12 Years for Sexual Abuse of Minor

Colin D. Stolle, Commonwealth's Attorney for the city of Virginia Beach, announced today that Marcus Anthony Upchurch, 42 years old, was sentenced today by Circuit Court Judge Glenn R. Croshaw for Aggravated Sexual Battery.  Judge Croshaw sentenced Upchurch to 20 years with 8 years suspended leaving 12 years to serve. He must also register as a sex offender, undergo sex offender therapy, remain on good behavior for 20 years, and be placed on supervised probation for an indeterminate period of time.  

Upchurch pled guilty on February 8, 2016. The Commonwealth's evidence proved that between February 2003 and September 2007, Upchurch sexually abused a child known to him.  The behavior continued for approximately four (4) years until the defendant moved out of state. When interviewed by police, Upchurch fully confessed to the crime.  ​

Upchurch has a similar conviction involving sexual abuse of a child from New Jersey.
