Commonwealth v. Robert Arthur Judd; Armed Robbery of Cinema Café Waitress Draws 15-Year Sentence

Wednesday, February 11, 2015

Colin D. Stolle, Commonwealth’s Attorney for the city of Virginia Beach, announced that Robert Arthur Judd, 29 years old, formerly of Outer Drive in Virginia Beach, Virginia was sentenced by Circuit Court Judge Glenn R. Croshaw for charges of Robbery, Wearing a Mask, Use of a Firearm, and Possession of a Firearm by Felon.  Judge Croshaw sentenced Judd to 63 years in prison with 48 years suspended leaving 15 years to serve.

Judd pled guilty on November 18, 2014.  Had this matter gone to trial, the Commonwealth’s evidence would have proven that on the evening of August 10, 2014, Judd and his co-defendant, Jason Gayatin Buhia, robbed a woman at gunpoint behind the Cinema Café on Independence Blvd in the city of Virginia Beach.  The woman worked as a waitress at the theater and was outside on a break.  Buhia and Judd wore masks and put a gun to the back of the woman’s head.  They took her phone, server’s apron, a booklet of her receipts and checks during her shift, and her cash tips for the evening. The gunmen then fled on foot.

The waitress reported the robbery immediately and officers began canvassing the area.  An officer with the Virginia Beach Police Department spotted the men.  When apprehended, Judd had a gun and $37 in cash on him.  Police also recovered bandanas used to cover the assailants’ faces.  Buhia confessed to the robbery and told police where they could find the victim’s apron and booklet.  The phone was never found.    Further, a security camera caught the robbery and the defendants’ clothes on camera matched what they were wearing when caught by police.

Buhia pled guilty to Robbery, Wearing a Mask, and Use of a Firearm and is scheduled for sentencing on March 2, 2015.

Judd has prior convictions for Burglary, Grand Larceny, Assault, Assault on a Law Enforcement Officer, Indecent Exposure, and multiple Violations of Probation.
