Commonwealth v. Brian Carl Batterson; Child Molester to Serve 25 Years in Prison

Colin D. Stolle, Commonwealth’s Attorney for the city of Virginia Beach, announced that Brian Carl Batterson, 44 years old, formerly of Camano Island, Washington, was sentenced today by Circuit Court Judge Glenn R. Croshaw for charges of Aggravated Sexual Battery – Victim Under Age 13, Forcible Sodomy – Victim Under Age 13, and Custodial Indecent Liberties. Judge Croshaw sentenced Batterson to 61 years in prison with 36 years suspended leaving 25 years to serve.  This sentence highly exceeded the Virginia State Sentencing Guidelines which recommended a maximum sentence of 14 years and 5 months.  

Batterson admitted that the evidence was sufficient to prove his guilt on November 5, 2014.  Had this matter gone to trial, the Commonwealth’s evidence would have proven that in Virginia Beach between May and October of 2003, Batterson sexually molested a 4-year-old child known to him.  The abuse was discovered when the child told a relative.  The family immediately notified police and an investigation was initiated.  By this time, the defendant lived in the state of Washington.  A detective from the Marysville, Washington police department interviewed Batterson and he confessed to the abuse although he falsely claimed the victim initiated the sexual contact.
