Commonwealth v. Kane Anthony Fosnaught; Armed Robbery in Mall Parking Lot Draws 15-Year Sentence

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Kane Anthony Fosnaught, 19 years old, who previously resided in the 700 block of Guy Avenue in Norfolk, Virginia, was sentenced today by Circuit Court Judge Edward W. Hanson Jr. for Malicious Wounding, Robbery, Attempted Robbery, Use of a Firearm (3 counts), and Conspiracy.  Judge Hanson sentenced Fosnaught to 32 years in prison, with 17 years suspended, leaving 15 years to serve.


Fosnaught was found guilty by Judge Hanson after a trial on March 6, 2013.  The Commonwealth’s evidence proved that on the evening of August 31, 2012, the two juvenile victims went to Lynnhaven Mall in the City of Virginia Beach. As the victims were leaving the mall with their purchases, Kane Fosnaught and his co-defendant, Garshamii Cox, followed them out of the mall and to their car.  As the juveniles were getting into the car, Fosnaught pointed a handgun at one of the victims and demanded his property.  The juvenile victim pulled out his own handgun and began to struggle with Fosnaught.  Cox reached into the car and tried to grab the victims’ property.  Seeing his friend struggle with Fosnaught, the other juvenile victim tried to help his friend.  Fosnaught turned and struck the second juvenile in the face with the gun, giving him a laceration and concussion.  Fosnaught and Cox then fled with the first victim’s gun and money. 


Police responded to the scene and apprehended Fosnaught in a store bathroom in the mall.  Fosnaught had the victim’s gun in his pocket.  Cox was later identified and confessed to his involvement in the robbery.    

Cox pled guilty and was sentenced to 17 years in prison with 8 years suspended leaving 9 years to serve.
