Commonwealth v. Darryl Wayne Gandy; Sexual Abuse of Child and Pornography Production Draws 15 Years to Serve

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced that Darryl Wayne Gandy, 39 years old, of Norfolk, Virginia, pled guilty and was sentenced yesterday by Circuit Court Judge H. Thomas Padrick on charges of Aggravated Sexual Battery, three (3) counts of Producing Child Pornography, and Possession of Child Pornography.  Pursuant to a plea agreement, Judge Padrick sentenced Gandy to 30 years in the Department of Corrections with 15 years suspended, leaving 15 years to serve.


Had this matter gone to trial, the Commonwealth’s evidence would have proven that between April 13, 2005 and April 12, 2006, Darryl Wayne Gandy sexually assaulted a young child, known to him, multiple times.   On July 25, 2011, another adult contacted police after finding a box of nude photos of the child taken by Gandy. During the investigation, Gandy admitted taking the pictures but denied sexually assaulting the child.


Gandy has prior convictions for Indecent Exposure and two (2) counts of Domestic Assault.
