Commonwealth v. Polite; 19 Year Old to Serve 10 Years for Armed Robbery

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Terrell Javon Polite, 19 years old, previously residing in the 800 block of Round Bay Road, Norfolk, Virginia, was sentenced today by Circuit Court Judge Frederick B. Lowe to twenty- eight (28) years in the Virginia Department of Corrections for Robbery, Use of a Firearm in the Commission of a Felony and Conspiracy.  Eighteen (18) years were suspended conditioned upon twenty (20) years good behavior.

 

At the guilty plea, the Commonwealth’s evidence proved that on November 22, 2008, the victim was walking home from work in the 400 block of Davis Street.  As the victim turned onto Davis Way, the juvenile co-defendant stepped in front of the victim, displayed a handgun and demanded his property.  Polite removed the victim’s wallet from his pocket.  During this time the victim looked at the gun, and believing the suspect had a fake gun, chased Polite and his co-defendant. He observed them get into a vehicle and obtained the license plate number.

 

Approximately 45 minutes later Polite and two others subjects were stopped in Norfolk for a robbery committed in that city. At the time, they were operating the same vehicle described by the victim.

 

A line-up was conducted with the victim, where he identified Polite and the co-defendant.  They both confessed to the robbery in Virginia Beach.

 

Polite had previously been sentenced for a Robbery and Use of a Firearm committed in Norfolk.
