Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Christopher Austin Averette, 32 years old, formerly of the 1300 block of Lucas Avenue in Chesapeake, Virginia, was sentenced by Circuit Court Judge Stephen C. Mahan for two (2) counts each of Robbery and Use of a Firearm. Judge Mahan sentenced Averette to 28 years in prison with 14 years suspended leaving 14 years to serve. Averette pled guilty on June 3, 2013.
The Commonwealth’s evidence proved that on the evening of November 16, 2012, Christopher Austin Averette and an accomplice committed a home invasion in the Bayside area of Virginia Beach. They went to a home with a couple of women who were known to the four residents. Because the residents knew the women, they allowed Averette and his accomplice into the home. After making conversation for a few minutes, Averette pulled out a pistol, ordered the four victims to the ground, and demanded they empty their pockets. He took wallets and cell phones. During the robbery, Averette pistol-whipped one man and kicked another. Averette and his co-conspirator fled from the house.
Detectives with the Virginia Beach Police Department began investigating the crime. Averette and his co-conspirator fled the Virginia Beach area temporarily after the home invasion. Averette was eventually apprehended by police on January 27, 2013. He admitted being in the home and to kicking and hitting someone, taking a cell phone, and having an unloaded gun.
Averette has prior convictions from North Carolina for three (3) counts each of Burglary, Grand Larceny, and Make/Possess Forging Instruments, two (2) counts each of Enter Vehicle/Boat to Commit Crime and Driving without a License, and one (1) count each of Possession of Schedule I/II Drug, DUI, and Obtaining Money by False Pretenses. He also has a conviction from Virginia Beach for Petit Larceny.
His co-defendant is awaiting trial on November 12, 2013.
