Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Trey Djuan McNair, 21 years old, previously residing in the 1000 block of Commonwealth Place in Virginia Beach, Virginia, was found guilty by a jury on three (3) counts each of Armed Robbery and Use of a Firearm, and one (1) count each of Wearing a Mask and Conspiracy. Circuit Court Judge Glenn R. Croshaw presided over the two-day trial. The jury recommended a sentence of 28 years and two (2) months in prison.
The Commonwealth’s evidence proved that at around 3:30 p.m. on July 3, 2011, six people were inside a home in the College Park section of the City of Virginia Beach. A juvenile acquaintance came over to watch a movie but shortly tried to leave the home. Trey McNair, Andrew Olds, and two other armed, masked gunmen forced their way into the home. McNair went into the downstairs living room and demanded the cell phones of two men. He wore a towel over his face, which fell down during the robbery, allowing two victims the opportunity to see his face. Olds and the other two co-conspirators went upstairs into a bedroom and demanded property from two sleeping victims at gunpoint. Andrew Olds was recognized by the victims and known to them from the neighborhood. Ultimately the four armed men fled the residence with cell phones, electronics, and marijuana.
The crime was thoroughly investigated by detectives with the Virginia Beach Police Department. Two victims were able to positively identify McNair in a photo line-up. When McNair heard he was wanted in connection with the crimes, he went into hiding. He was arrested on November 10, 2011, in the Lake Edward section of Virginia Beach.
Andrew Olds and the juvenile who visited the home to watch a movie were also arrested and charged in connection with the home invasion. Andrew Olds pled guilty to two (2) counts of Armed Robbery and Use of a Firearm, and one (1) count each of Wearing a Mask and Conspiracy. He is serving eight (8) years. The juvenile pled guilty to Armed Robbery (2 counts), Conspiracy, and Use of a Firearm. He was committed to the Department of Juvenile Justice.
McNair’s prior record includes a conviction for Assault and Battery.
