NOTICE OF PUBLIC HEARING

The Virginia Beach Planning Commission will hold a Public Hearing on Wednesday, March 14, 2012 at 12:00 Noon in the Council Chambers of the City Hall Building, Virginia Beach, Virginia to consider the following applications.  A briefing session will be held at 9:00 a.m. in the City Manager's Conference Room, City Hall Building.  Copies of the proposed ordinances, resolutions and amendments are on file and may be examined in the Department of Planning.  For information call 385-4621. An Ordinance to amend Sections 111 and 1804 of the City Zoning Ordinance, defining “Indoor Play Centers” and designating such use as “Incompatible” in the Clear Zone and Accident Potential Zone-1, re-designating certain Manufacturing uses as “Compatible” in the Greater than 75 dB DNL Noise Zone and in Accident Potential Zones 1 and 2, and adding “Religious Uses” to Tables 1 and 2 or Section 1804.

14. CITY OF VIRGINIA BEACH – ORDINANCE TO AMEND SECTION 1810  APPROVAL (COUNCIL on April 24)
An Ordinance to amend Section 1810 of the City Zoning Ordinance pertaining to Comprehensive Plan references for Design Features for structures located in APZ-1.

15. CITY OF VIRGINIA BEACH – OCEANFRONT FORM-BASED CODE DEFERRED
An Ordinance to amend the Official Zoning Map to change the zoning district classification of all property located within the geographic area described in the following boundary description from its present zoning district classification (RT-1, RT-2, RT-3 or RT-4 Resort Tourist District or A-12 or A-36 Apartment District or B-2 Community Business) to the “OR Oceanfront Resort District” and to eliminate the  Laskin Road Gateway Overlay District, and to  adopt and incorporate as part of the Official Zoning Map the Frontage Map, Setback Map and Height Map (dated January 2012) as displayed to the City Council and reproduced in the Oceanfront Resort District Form-Based Code. The OR Oceanfront Resort District allows a wide range of building types and uses, including, but not limited to, retail, commercial, residential, civic, lodging, institutional, mixed and recreational uses without limitation as to density.

16. CITY OF VIRGINIA BEACH - ORDINANCE TO AMEND THE CITY ZONING ORDINANCE  DEFERRED
An Ordinance to adopt the Oceanfront Resort District Form-Based Code as Appendix 1 to the City Zoning Ordinance. 

17. CITY OF VIRGINIA BEACH –OCEANFRONT FORM-BASED CODE DEFERRED
An Ordinance to conform certain provisions of the City Zoning Ordinance to the provisions of the Oceanfront Resort District Form-Based Code by amending City Zoning Ordinance Sections 102 (adding the OR Oceanfront Resort District as a zoning district), 105 (additions to or alterations of nonconforming uses and structures in form-based districts), 107 (effect of conditional zoning proffers in Strategic Growth Areas), 108 (special exception applications for alternative compliance in form-based districts/posting of signs), 111 (deleting certain definitions pertaining to signs), 200 (number of dwellings allowed on a lot in the OR Oceanfront Resort District), 201 (permitted encroachments into required setbacks in the OR Oceanfront Resort District), 203 (height regulations), 204 (off-street loading requirements in form-based districts), 208 (portable storage containers in the OR Oceanfront Resort District), 226 (bicycle and moped rental establishments in the OR Oceanfront Resort District), 239.05 (parking structures located in form-based districts), 244 (design standards for retail establishments and shopping centers), 245 (deleting references to the RT-2 Resort Tourist District), 1500 (legislative intent of RT Resort Tourist Districts), 1501 (RT-1 District consistency with the Resort Area Strategic Action Plan), 1505 (off-site parking facilities for hotels and motels in the RT-1 District), 1507 (RT-1 District performance standards/consistency with Resort Area Strategic Action Plan), 1520 (RT-3 Resort Tourist District legislative intent/consistency with Resort Area Strategic Action Plan), 1521 (RT-3 District Use Regulations/Consistency With Resort Area Strategic Action Plan), 1523 (RT-3 District sign regulations), 1524 (RT-3 District off-street parking regulations), 1526 (RT-3 District performance standards and incentives) and 1804 (AICUZ regulations in 65-70 dB DNL Sub-Area 2 Noise Zone), repealing sections 1510 (legislative intent RT-2 Resort Tourist District), 1511 (RT-2 District use regulations), 1512 (dimensional requirements RT-2 District), 1513 (sign regulations RT-2 District), 1514 (off-street parking regulations RT-2 District), 1515 (RT-2 District density), 1516 (RT-2 District performance standards and incentives), 1540 (RT-3 (LRG) Laskin Road Gateway Overlay District legislative intent), 1541 (application OF LRG Overlay District regulations), 1542 LRG Overlay District use regulations), 1543 (LRG Overlay District dimensional requirements and density), 1544 (LRG Overlay District sign regulations) and 1545 (LRG Overlay District off-street parking regulations), and adding a new section 107.1 (SPECIAL exceptions for alternative compliance in form-based districts).

AND ADD A NEW SECTION 210.2 DEFERRED
An Ordinance to amend City Zoning Ordinance Sections 111 (deleting definitions of certain sign types), 210 (determining number of signs and sign area), 211(signs permitted in all districts), 212 (prohibited signs) and add a new section 210.2 (adding new definitions of certain types).

An Ordinance establishing Transition Rules for the review of Site Plans, Subdivision Plats and other Plans of Development for property in the OR Oceanfront Resort District.

20. CITY OF VIRGINIA BEACH - AMEND SECTION 5 FOR THE OR OCEANFRONT RESORT DISTRICT DEFERRED
An Ordinance to amend Section 5 of the Site Plan Ordinance, pertaining to Transitional Buffers, Multi-family Usable Open Space and Condominium Development Open Space in The OR Oceanfront Resort District.
